These terms govern the use of AnnaiDesk (the “Service”) and apply to everyone who uses it: tour companies, guides and travellers. The Japanese version prevails if the two versions differ.
1. The Service
The Service provides software for tour companies to publish tours, manage bookings, issue quotes and confirmations, and schedule and pay guides.
The operator of the Service is not a travel agency and is not a party to the planning, sale or operation of any tour. A contract for a tour is made between the traveller and the tour company.
2. Accounts
A tour company applies for an account, which is opened after review by the operator. Registered information must be accurate and kept up to date.
Guides register with an email address and use the Service free of charge. One guide account can be linked to several tour companies.
You are responsible for keeping your login details safe.
3. Fees and free trial
A tour company may use the Service free of charge for 30 days from the day its application is approved.
To continue after the trial, the company pays the fee of the plan it selected. Fees and payment methods are set out in the legal notice.
4. Responsibilities of tour companies
Tour companies publish, sell and operate tours on their own responsibility and in compliance with the Travel Agency Act and other laws. They are responsible for the accuracy of their public pages, prices and cancellation policies.
Personal data of customers and guides that a tour company enters into the Service is collected and controlled by that company; the operator processes it on the company’s behalf.
5. Prohibited conduct
You may not break the law, register false information, infringe the rights of others, interfere with the operation of the Service, or attempt unauthorised access or reverse engineering.
6. Changes and suspension
The operator may change or suspend all or part of the Service without notice for maintenance, outages or other unavoidable reasons.
The operator may suspend an account that breaches these terms.
7. Disclaimer
The operator is not responsible for the content or operation of any tour, or for disputes between travellers and tour companies or guides.
Except in cases of intent or gross negligence, the operator’s liability is limited to the fees the user paid in the preceding month.
8. Amendments and governing law
The operator may amend these terms when necessary and will announce material changes in the Service or by email.
These terms are governed by the laws of Japan. The court with jurisdiction over the operator’s location has exclusive jurisdiction at first instance.
